日損害賠償ウ損害賠償

損害賠償（そんがいばいしょう）とは、主に民法や民事紛争における法律用語である。違法な行為により損害を受けた者（将来受けるはずだった利益を失った場合を含む）に対して、その原因を作った者が損害の埋め合わせをすること。適法な行為による損害の埋め合わせをする損失補償とは区別される。
近代以降の法律においては民事紛争と刑事紛争とが峻別されるようになり、また、人権意識も向上したため、金銭賠償が原則とされるようになってきている。
損害賠償制度の目的としては損害の補填と将来の違法行為の抑止などが挙げられる。
