- 汚職(おしょく)とは、公職にある者が、その地位や職権を利用して収賄や個人の利益を図る不正行為を行うことをいう。狭義には収賄、受託収賄及び事前収賄罪が該当するが、他に背任罪、虚偽公文書作成等罪、偽計業務妨害罪などがある。
- 不正行為には贈収賄や便宜供与のほかに、作為・不作為による公務上の義務に反する行為がある。公務上の義務に反する行為は、違法行為を黙認する不作為も含めて公務員職権濫用罪に問われる。
- なお汚職の語源は「職をけがす」という意味の「瀆職」(涜職)(とくしょく)で、「瀆」が当用漢字に入れられなかったため、言い換えられて「汚職」になった。
- 国際的な組織犯罪の防止に関する国際連合条約を始めとした国際法では、汚職は『腐敗』の一部と認識されており、トランスペアレンシー・インターナショナルは毎年世界の腐敗度を示す腐敗認識指数を発表している。
